ACCEPTABLE USER POLICY

As a high-quality web hosting provider to thousands of customers, Crux Softwares values its good reputation. Accordingly, it is important to us that our customers use our services and the Internet in general, responsibly and courteously. Most of our customers do so and seldom need to refer to these AUPs. Nonetheless, the following constitute examples of unacceptable uses of Crux Softwares's services, which will result in suspension, or termination of the customer's account.

Affronts to Etiqutte. +

Unacceptable activities include spamming (sending unsolicited advertising to those with which the customer has no existing business relationship, posting off-topic advertising in newsgroups); spoofing (using a return email address which is not the valid reply address of the sender or sending an email message which does not contain enough information to enable the recipient to identify the party who is really sending the message; passive spamming (promoting a web site hosted by Crux Softwares by spamming from some other source), trolling (posting controversial messages in newsgroups to generate responses), mailbombing (inundating a user with email without any serious intent to correspond), generating a higher volume of outgoing mail than a normal user (over 10% of available system resources), and subscribing someone else to an electronic mailing list without that person's permission. A message is considered unsolicited if it is posted in violation of a newsgroup charter or sent to a recipient who has not requested the message. Making an email address available to the public does not constitute a request to receive messages. Distribution of mass emailing programs is also prohibited. All recipients on a mailing list must have personally subscribed.. Mailing lists may not be used to distributed unsolicited email. Any customer repeatedly "mailbombed" or that attracts such behavior will be asked to leave. If you are not sure if your actions will be in violation, please ask first (abuse@cruxsoftwares.com).

Age +

The client must be 18 years of age to obtain our service.

Abuse of The Legal Rights of Others. +

Examples of unacceptable activities in this regard include posting private information about a person without their consent, infringing intellectual property rights, defaming a person or business, and knowingly making available code which will have a deleterious effect on third party computers. Crux Softwares supports free speech on the Internet, and will not suspend or cancel a customer's account simply because it disagrees with the views expressed by the customer. Where there are allegations that a customer's on-line activity has violated the legal rights of a third party, Crux Softwares will not substitute itself for a court of law in deciding tort claims raised by the third party.

Abuse of the Law+

Crux Softwares's services may be used for lawful purposes only. Illegality includes but is not limited to: drug dealing; attempting without authorization to access a computer system; pirating (distributing copyrighted material in violation of copyright law, specifically MP3s, MPEG's,ROMs, and ROM emulators); gambling; schemes to defraud; trafficking in obscene material; sending a message or having content that is obscene, lewd, lascivious, filthy, or indecent with intent to annoy, abuse, threaten, or harass another person; threatening bodily harm or damage to individuals or groups; violating U.S. export restrictions; stalking; or violating other state or federal law such as the Electronic Communications Privacy Act, the Computer Fraud and Abuse Act, or the Economic Espionage Act. Linking to illegal material is also prohibited. Anything violating Indian Law will be considered as abuse of our services and the person indulging in the same will be considered totally liable for his acts. On finding this we will disctoniue the services immediatley and inform the same to the Law inforcement agencies to take care of the situation. This will not arising any liablity on Crux Softwares.com or any of its associates, partners or proprietor. Crux Softwares reserves the right to check system files, email, and other data on our servers for illegal content and materials, or for any other reasons deemed necessary.

Pornography +

Pornography and sex-related merchandising, or links to such material, even if legal, is not an acceptable use of Crux Softwares's servers.

Abuse of Crux Softwares's Server Resources+

Running programs in the background on a Crux Softwares's server without Crux Softwares's prior written authorization, or running chat rooms, Internet Relay Chat, IRC bots, Greeting Cards sites, software downloading sites, more then 1000 emails a day and the like are not acceptable uses of Crux Softwares's servers. Further, any usage of ten percent (10%) or more of our system resources is an undue burden on our system and is unacceptable. If your usage ever exceeds ten percent (10%) of system resources, your account may be terminated immediately and without prior notice. In addition any domain that exceeds ten gigabytes of bandwidth traffic can be terminated without prior notice. Usage of scripts or other utilities to direct pointed domain names to subdirectories is not permitted and is grounds for termination of the account.

Hacking/Cracking +

Crux Softwares reserves the right to report illegal activities to any and all regulatory, administrative, and/or governmental authorities for prosecution. The following examples of unacceptable behavior are non-exclusive, and are provided for guidance purposes. If you are unsure if your actions will be a violation of our policies please contact abuse@cruxsoftwares.com Server broadcast messages or any message sent on an intrusive basis to any directly or indirectly attached network Attempt to circumvent any user authentication or security of host, network, or account. Accessing data not intended for user. Probing the security of any network. Spawning dozens of processes. Port scans, ping floods, packet spoofing, forging router information, Denial of Service attacks, sniffers, flooding, spoofing, ping bombing, smurfs, winnuke, land, teardrop. Promulgation of viruses. IRC bots such as eggdrop or BitchX. Any activity, whether or not the intrusion results in the corruption or loss of data, will be investigated and proper action taken. The presence of any of these programs, whether or not run, will result in action against the user including suspension or termination.

Client Responsibility+

The client is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery. The client is responsible for securing their username/password. The client assumes responsibility for all material on their site that may be put on by a third party (such as the usage of Free For All links pages). Use of Crux Softwares's service requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of the web space by the client. The following examples are offered: Web Publishing:requires knowledge of HTML, properly locating and linking documents, FTPing Web contents, Graphics, text, sound, image mapping, etc. FrontPage web publishing: knowledge of the FrontPage tools as well as Telnet and FTP understanding and capability. CGI-Scripts: requires a knowledge of the UNIX environment, TAR & GUNZIP commands, Perl, CShell scripts, permissions, etc. Mail: a use of mail clients to receive and send mail, etc. The client agrees that he or she has the necessary knowledge to create and maintain their web space. Client agrees that it is not the responsibility of Crux Softwares to provide this knowledge or support outside matter specific to Crux Softwares's servers.

Backups +

No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the clients' responsibility to maintain local copies of their web content any information. If loss of data occurs due to an error of Crux Softwares, Crux Softwares will attempt to recover the data for no charge to the client but does not guarantee its recovery. If data loss occurs due to negligence of client in securing their account or by an action of the client, Crux Softwares will attempt to recover the data from the most recent archive for a Rs.6000/- fee.

IP Numbers+

Crux Softwares maintains control and any ownership of any and all I.P. numbers and addresses that may be assigned to the client and reserves in its sole discretion the right to change or remove any and all IP numbers and addresses.

Limitation of Liability +

Crux Softwares shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Crux Softwares's servers going off-line or being unavailable for any reason whatsoever. Further, Crux Softwares shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Crux Softwares's servers. All damages shall be limited to the immediate termination of service. Crux Softwares shall be the sole arbiter of what is and is not a violation of these acceptable use policies. Crux Softwares reserves the right to terminate an account at any time and for any reason that causes harm to any Crux Softwares customer's web sites. Crux Softwares reserves the right to delete all content and files upon termination. Crux Softwares reserves the right to withhold any pre-paid funds for any site removed for violations of these policies. Crux Softwares reserves the right to refuse, cancel, or suspend service at our sole discretion. Crux Softwares reserves the right to change the Acceptable Use Policy without prior notice or warning. Non-enforcement of any part of the Acceptable Use Policy does not constitute consent. Violations of these Acceptable Use Policy should be referred to abuse@cruxsoftwares.com All complaints will be investigated promptly.

Collection of Personal Information for Propagating Business. +

In some circumstances, Crux Softwares may request for some personal information from you, like your name, e-mail address, company name, or telephone number. in order to help serve you better be it by informing you of new services, products, alliances etc that could help you in your business. In general, you can visit our site without disclosing any personal information. However, there are areas of this site that require this information to complete certain functions, and may not be available to those choosing not to reveal the information requested. You recognize and understand that there is no compulsion on you to provide us with your personal information and any and all personal information provided by you to us is with your full consent, own volition and desire to provide such personal information. You also understand that we are under no obligation to verify the source from which the personal information about you is provided to us, and they are deemed to be provided by you.

ICrux Softwaresis just a service provider company and working or giving orders to us means that you take 100% reponsibility of any legal issues of such kind on behalf of Crux Softwares also.

All the sites made by Crux Softwares which are not allowed to be resold. Any person/ex-employee/company/buyer/unknown person cannot buy/sell/rent/opensource or transfer with/without fees/cost to anyone without prior permissions of Crux Softwares. Any person found in such activity will be charged against case of theft and will have to bear consequences and legal issues.

Because email and instant messaging are not recognized as secure communications, we request that you not send private information to us by email or instant messaging services. Payments, Billing and Pricing +

You must always maintain a positive credit balance in your account. You can find list of payment options at https://cruxsoftwares.com/payment.html.

Please note that Crux Softwares offers various payment options for ease of payment to the customer. Transaction fees, service charges of such payment options are separate and must be added to your total account fee separately and paid in total. Once you make the payment, you must intimate Crux Softwares by creating a ticket in the members area with full details such as to which of our account payment was made, Mode of payment, Amount paid, Service for which the amount is paid, Date of payment and other payment details such as Bank, Branch, Account number details. If you do not have access to the members area, you may create a ticket at https://cruxsoftwares.com . If no such intimation is provided, account setup or renewal or other account related functions cannot be completed. Crux Softwares will take 48 hrs – 72 working hrs to verify and execute an order. Usually it takes only few min, but in rare cases we may have to verify fraudulent payments and hence 48 hrs – 72 working hrs will be the time taken to verify and execute an order

It is customer responsibility to intimate Crux Softwares about the payment & other details and make sure that an domain / account renewed. Domains/ Accounts must be renewed atleast 30 days prior to expiry to prevent last minute glitches, act of god, issues at registry’s end etc.

It is the responsibility of the customer to make sure that correct and working email id is in file with Crux Softwares. Crux Softwares will send all email alerts about renewals, registration, transfers, offers as a courtesy by email. It is the responsibility of the customer to login to the members area and respective control panels to keep track of their account status.

All account fee must be paid in advance in full before the actual term. Crux Softwares will charge 20% of the account fee or Rs.500, whichever is higher as a late fee.

Crux Softwares will add credits to an account only when the payment is fully reflected in Crux Softwares bank accounts. Part payments will not be added to an account. If transaction or processing fee is not added with the amount paid, Crux Softwares will only add the exact amount after deducting such a processing fee. Returned cheques will attract Rs.500 towards cheque returning charges and admin charges. Once a cheque is returned, the customer will have to make all further payments as Cash/Bank Account Transfer to our accounts and no other mode of payment will be accepted. Outstation cheques will attract Rs.100 as collection charges.

No payment has to be sent to us directly. All payments must be paid directly to our Bank Accounts available in https://cruxsoftwares.com/payment.html.

We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

Accounts that are not renewed on time will be suspended / terminated immedietly.

Crux Softwares only adds domain credits to a reseller / customer account. We will not register / renew / transfer any domain name / hosting. It is the sole responsibility of the customer / reseller to register / renew / transfer domain name / hosting.

Billing / Price Changes / Discounts & Coupons. +

Crux Softwares policies and prices are subject to change without notice. Any price changes become effective in the next billing cycle except in exceptional cases such as volatility in FOREX and other factors which are not in Crux Softwares hands. We reserve the right to change pricing, resources, features of plans that are displayed in our websites or partner websites.

Discounts / Coupons offers are one time only and are not applicable during the renewal of the account. Discounts / Coupons are for first time customers only and the same customer cannot avail other offers for the same account / domain on a later date. If found in violation of these terms, the discount or offer will cancelled and additional invoices will be added to your account.

Cancellation Policy. +

Hosting plans will automatically expire until a plan is renewed. In order to cancel service, you must contact Crux Softwares Billing Team by creating ticket in the members area with proper payment details and account details. Cancellation requests must be received by Crux Softwares a minimum of thirty (30) days prior to the end of your Billing Cycle. Crux Softwares will confirm the cancellation request when it is processed. If you do not receive a confirmation, please contact Crux Softwares as soon as possible.

Refund Policy. +

Strictly there are NO refunds for Web Hosting Plan/s [Starter, Silver, Gold, Platinum / Premium Packages, Special Promotional Packages], Any Email Hosting Plan/s, Any SEO Plan/s, Web Promotion Plan/s, Monthly Billed Packages, Discounted Packages or Coupons.

Strictly NO refunds will be processed for package that are cancelled during the FREE period. [ For example, In a 2 +1 year pack, the last year is provided as FREE and hence no refund can be processed for/during that period ].

Strictly NO refunds will be processed if the account fee is not paid Full in advance before the account is setup.

Strictly NO refunds will be processed if a refund is requested after 3 days from the date of order of the account.

Strictly NO refunds will be processed if an account was involved in abuse / resource over usage previously.

Domain Credits purchased cannot be refunded.

Only first time accounts are eligible for refund. Accounts created by the same customer / related to the same customer will not be eligible for refund.

Dedicated Servers and Cloud Servers are not eligible for any refunds.

All request for refund must be provided in writing by creating a ticket in the members area. Only refund request that does not fall under any of the above conditions will be responded or taken into consideration. The maximum refund possible is 50 % of account fee that is paid in full advance before account setup.

Setup fee [both levied or waived off ], Software costs, Administration costs, other third party expenses will not be refunded. Processing fee of Rs.500 will be charged for all refunds. Refund processing will take 90 days from the date of acceptance of refund by Crux Softwares.

In no circumstances Government Taxes will be REFUNDED.

Terms of Use, Notices and Revisions +

Your use of Crux Softwares, and any disputes arising from it, is subject to this Privacy Policy as well as our Terms of Use and all of its dispute resolution provisions including arbitration, limitation on damages and choice of law. We reserve the right to change our Privacy Policy and our Terms of Use at any time. Non-material changes and clarifications will take effect immediately, and material changes will take effect within 30 days of their posting on this site. If we make changes, we will post them and will indicate at the top of this page the policy's new effective date. Crux Softwares defines Spam as unsolicited broadcast or commercial email that is sent to addresses that do not affirmatively and verifiably request such material from that specific sender, including but not limited to advertising, surveys, information pieces, third party spamming, Web site addresses, sales, and auctions.
